How long do I have to make a claim?
When you get injured on the job, you've only got 30 days to let your employer know that you got injured on the job. So it's very, very important when you get injured you let somebody know immediately. Most kinds of personal injury cases in Texas, you've got two years in order to do something about your personal injury. On workers' comp, you only get 30 days. After you let your employer know within the 30 days, you're limited to only one year to let the insurance company know.
And so what happens with a lot of working people is, especially with back injuries, they will go and they'll tweak their back. They just feel a minor soreness. They some Advil or some type of ibuprofen at work. They go about their business. But then whenever they get home, it freezes up on them. Then they start noticing that they've done something more serious. The next day, tell your employer. Don't wait around. You need to let somebody know immediately. And then once you've done that, call a lawyer and talk to a lawyer.
